H1B visa [top]

An H1B visa is a work permit issued by a US Consulate/Embassy to an "alien"/foreign worker enabling him/her to work in the US temporarily. There are other options available for those who wish to work in the United States temporarily, like getting an intra-company transfer visa (L1), or a business visa (B1), or even a green card. The H1B work permit visa is the most common one.

H1b visa procedure [top]

The H1B visa is tied to the employer. This means that you must have a sponsoring employer in order to apply for the visa. The following are some of the documents that your prospective employer is required to file, in order to apply for your visa:

Documents required for the visa [top]

1. Passport - The expiration date on the passport must be more than 6 months away.


2. All documents sent by your employer

  •  Employee's Copy of approved form I-797
  •  Petition for Nonimmigrant Worker
  •  Labor Certification Approval
  •  Appointment letter by your Employer
  •  Tax Return Papers of the company (if your employer sends them)
  •  Copy of Employer's letter to the Department of Justice
  •  Copy of letter to the Consular General of the Indian consulate
  •  A copy of the official evaluation of your degrees (if your employer sends it)

3. Your certificates: Include Originals and Copies

  •  Degree certificate
  •  Appointment and Relieving letters for all the companies where you claim employment OR Service certificates from the company giving dates and duration of your service.

4. A copy of your resume, any additional diploma or supporting certificates, just for good measure.


5. Two DDs taken in favor of the name specified -- one for Processing Fee and the other for Issuance Fee. The demand draft must be drawn on a nationalized or foreign bank which has a branch in city where the consulate is located. Demand drafts from cooperative banks are not accepted by consulates.


6. Two/three passport size COLOR photographs taken within the past 6 months.

H1 application status [top]

If you have an application receipt number ( a unique 13 digit alphanumeric number assigned by INS), you can check the status of your case online.
All you need is your 13 digit receipt number. Here is the Online Tracker from INS: Check your case status. You may obtain case status by calling 1 (800) 375-5283, and following the automated instructions. Have your receipt number ready.

 

 

Labor Certification Attestation  [top]

A Labor Condition Application is used in H-1B applications. It is a document that must be certified by the Department of Labor which details the conditions of employment: the employer, occupation, rate of pay, prevailing wage (the lowest wage an employer can pay a foreign worker), and the location of the facility where the foreign worker will work, as well as certain statements. LCA processing is taken care of by the employer.

 

 

Premium Processing Service - Fast track H1 B visa [top]

The Premium Processing Service allows expedite the procedures for visa processing. The U.S. Citizenship and Immigration Service (USCIS, formerly the INS) guarantees that it will process the visa petition within 15 days under this service. There is a $1,000 fee that your employer must pay to the USCIS in order to use this service. Also, a separate phone number and e-mail address is provided for companies using the expedited processing to check on their status or ask questions.
Only your employer or business can apply for this service. You cannot do so as an individual. Your employer must complete Form I-907 (Request for Premium Processing) and pay the fee of $1,000.

Obtaining visa for the family  [top]
